1. Applicability
These terms and conditions apply to the services offered by 7Oceans GmbH in its own name. These include, in particular, services of the diving specialist shop including the online shop, the workshop and the diving school, in particular the implementation of diving courses. If 7Oceans GmbH arranges travel arrangements or services of other tour operators, their contract and travel conditions apply in addition.

2. Right of return / Complaints
The 7Oceans GmbH always strives for the highest quality. Wrong or damaged goods can be returned within 14 working days from the date of sale with original receipt. 7Oceans GmbH offers service and repair work on diving equipment such as regulators, bottles, etc. Any defects are to be objected to immediately after discovery, at the latest within three months since the return of the material to the customer. Late complaints will not be received.

3. Insurance
The participant is not insured by 7Oceans GmbH and participates in diving courses at his own risk. The participant undertakes to independently provide sufficient insurance cover. It is strongly advised to take out a cancellation insurance. In addition, membership in the Swiss Underwater Sports Federation (www.susv.ch) is recommended. This provides worldwide protection for scuba divers and is an optimal addition to the Swiss health insurance.

4. Liability
7Oceans GmbH is liable in cases of intent or gross negligence in accordance with the statutory provisions. The liability for slight negligence is excluded. The liability for vicarious agents is excluded. Within the scope of the Product Liability Act, 7Oceans GmbH is solely liable for injury to life, limb or health or for the violation of essential contractual obligations. The claim for damages for the slightly negligent breach of essential contractual obligations in this case, however, is limited to the contract-typical, foreseeable damage, as far as liability is not due to injury to life, limb or health.

5. Dive ability
The participant agrees to truthfully fill out the forms submitted to him and to inform the trainer at any time and immediately about changes in the state of health that affect the ability to dive. 7Oceans reserves the right to exclude participants from diving courses if they are worried

6. Diving Courses

6.1. Registration / Confirmation
Registration for a diving course can be done in writing, by telephone or orally and is binding. Sometimes the number of participants is limited. Short-term registrations are possible upon request but can not always be guaranteed. The course confirmation is in writing. Only through the course confirmation participation is guaranteed.

6.2. Price / payment:
The entire course price must be paid in cash or by bank transfer by the specified payment deadline. Only the services listed in the detailed program and / or internet are included in the course price. If the course fee is due at the beginning of the course, 7Oceans reserves the right to exclude the participant from the course.

6.3. Termination by the participant or no-show:

6.3.1. Registration fee
If the participant withdraws or does not participate in the course, regardless of the time, 7Oceans will charge a registration fee of 20% of the course price. The assertion of costs for any expenses already incurred (material, etc.) remains reserved. 7Oceans points out to the participant that these costs are not covered by the insurance and must always be paid by the customer. In case of no-show without cancellation from the course, the full course fee has to be paid.

6.3.2. Costs at cancellation
Within 5 working days of the beginning of the course, 7Oceans will also charge a registration fee of 20% of the course price. If the participant has to interrupt an ongoing diving course, completely cancel it or if he does not appear unfounded for the diving course, the costs will not be reimbursed. You will be asked for a replacement if you have a medical certificate or if there are serious reasons.

6.4. Course cancellations / program changes by 7Oceans
7Oceans reserves the right to cancel a diving course if there are insufficient numbers of participants or other circumstances (eg force majeure, etc.). As far as possible, 7Oceans will carry out the diving course according to its schedule, but reserves the right to change the program, services, etc., if this appears necessary due to objective circumstances. If the diving course is canceled by 7Oceans or no substitute program is offered, the participant is entitled to a refund of the diving course costs. Further claims are excluded.

7. Severability clause
Should one or more of the above provisions be invalid or incomplete, this shall not affect the validity of the remaining provisions. The contracting parties undertake to replace the ineffective provision by a provision that comes closest in content to the original intention

8. Application of law and jurisdiction
The legal relationship with 7oceans GmbH is governed exclusively by Swiss law. The exclusive place of jurisdiction is Horgen, Switzerland.
